Property Division ​

This page is available for pre-decree cases. It lists all assets and debts, and provides you with option to divide the property between the parties.

The property division page

For each property, you can do the following:

  • Assign the entire property to one of the parties using the 100% buttons.
  • Split equally between the parties using the 50%/50% button.
  • Enter any custom percentage by typing it directly into the percentage fields.
  • Enter any custom amount by typing it directly into the $ amount fields.
  • Press the Clear button to remove the assignment.
  • Exclude the property from the totals. Separate Property (Section I) and Separate Property Interest (SPI) are excluded by default, but you can override this for each property.
  • Provide a comment for each property. By default, the property comment from the file editor is shown. Enable the Override Comment option to enter a division-specific comment instead. Comments appear only on the generated property division documents, not on the Sworn Financial Statement.

Every time you make a change, the system recalculates the division and updates the page header summary: the total for each party, the difference between them, and the amount required to equalize the parties.

Generating Documents ​

The page header provides the following options:

  • Download Spreadsheet: download a live spreadsheet that can be altered during negotiations.
  • Download PDF: generate a well-formatted PDF of the property division.
  • Print Preview and Email: available with an active subscription, like on the other print pages.

Excluded Separate Property, Separate Property Interest and separate debt balances are not listed on the generated documents. They are not divided and are not part of the totals, so there is nothing to say about them. Override the exclusion for such a property to have it divided and listed.

Press the Options button to customize the generated documents. The options apply to both the spreadsheet and the PDF:

  • Party Labels: first name, last name, full name, party type, or custom labels.
  • Show or hide the Evaluation Date.
  • Comments: show as a column, on hover, or hidden.
  • Show or hide the Undivided Amount and Excluded columns.
  • Round Values and Show Dollar Symbols.

Press Remember Options to save the current options as your default.

Auto-Calculation ​

Enable the auto-calculate switch to auto-divide all unassigned property between the parties. The auto-calculation function divides UNASSIGNED assets and unsecured debts between the parties. It does not modify your assignments!

It assigns separate property and SPI to the owning party, if set. It then balances out the difference between the parties. If there are assets and debts left, it divides them equally between the parties.

The auto-calculation runs every time it detects a change to a division, or when an asset or debt balance changes.
